Justice Mary Asemota of the Edo State High Court in Benin City announced on Monday that the case involving the suspended Enigie (Benin Dukes) and the Oba of Benin has been adjourned to February 20, 2025. The adjournment follows a request linked to a ‘change-of-guard’ in the Edo State Government, allowing the new Attorney-General, Dr. Samson Osagie, time to study and respond to the court process.

The case was initiated by Prof. Gregory Akenzua of Evbuobanosa Dukedom and Edomwonyi Ogiegbaen of Egbaen Siluko Dukedom, who were removed from office by the Oba of Benin. The suspension followed allegations of rebellion against the Benin monarchy.

During the hearing, Justice Asemota emphasized the necessity of the adjournment to facilitate proper review by the new Attorney-General. She stated, “The decision to adjourn the case to February 20, 2025, is hinged on a ‘change of guard’ to enable the Attorney-General to study and respond to the court process accordingly.”

Legal Arguments and Courtroom Developments
Dr. Osagie Obayuwana, counsel for the claimants, referenced an affidavit for an extension that had been filed by the former Attorney-General, Oluwole Osazee-Uzzi. This filing played a role in prompting the court to grant the adjournment.

The state Attorney-General, Dr. Osagie, who is the second defendant in the suit marked B/250os/2023, supported the adjournment request. He explained that the decision was based on a mutual agreement among the legal teams representing all parties. He further clarified that the state government’s transition necessitated the postponement.

Legal Representation in Court
Kingsley Obamogie and his team represented the first defendant, the Oba of Benin, during the proceedings. Meanwhile, P. O. Okoduwa appeared on behalf of the third defendant, the Benin Traditional Council.
